All, AY. G. Jiiddell, 5..M., delivered judgment yesterday in a case in which tlio United Building Society claimed .£52 2s. 9d. from John iiearlc and Mary Searlo lor loaned money and interest. Jn the course of the judgment, his Worship said; "The evidence discloses the fact that tho two defendants (John and Mary Stark') are not on good terms, and that tho money was obtained by John Searlo upon untrue statements, and by methods which were not acquiesced in by Mrs. Bcarle. Whether both defendants, or only one, are liable depends laigcly upon the credibility of ono as against the other, but, after hearing the evidence, I prefer to, accept Airs. Searle's statement that she was not a party to obtaining the money now sued for, and did not in any way ratify the transaction." Judgment was for the Building Society against Jolm Searlo for the amount claimed, with costs £5 17s. As against Mrs. Searle plaintiff was nonsuited. BAKKISTER'S CAE. Henrj l Hubert Ostler, barrister, WeiJington, claimed £20 from the Shaw, Savill, and Albion Co., Ltd., respecting the carriage of a motor-car, which, it was alleged, had not been delivered in good condition; £li was clai;iicd as the cost of repairs, and JjG by way of general damages. Mr. T. Neave appeared for the plaintiff, and Mr. M. Myers for the defendant company.

Dr. Jl'Arthur, S.M., heard evidence in the case, and reserved decision. SMALL CLAIM. S. G. Radford sued George Leavey for .64 18s. 3d. as for refund on an insurance policy and rent of telephone. Judgment was for plaintiff for £1 lis. Mr. E. M. Sladden represented the plaintiff, and Mr. P. W. Jackson tho defendant. BOARD ACCOUNT. Charles Edwards obtained judgment against Joseph S. Stott for £5 125., as money due on account of board and lodgings. POSSESSION OF PIAXO. The Dresden Piano Company proceeded against Ellen Kelly for possession of a piano and .£2l Is. hire money. Judgment was for plaintiff; the instrument is to be handed over within fortj-neight hours. UNDEFENDED CASES. JUDGMENT -SUMMONS. Ernest Henry Dodd was ordered to pay J; B. Lane J!10 7s. by August 5. BREACH OF AWARD. A penalty of £2 for a breach of the Wellington Shop T'ailoresscs' Award was imposed on W. Larendcr. The breach consisted iu failure to pay award-rate wages to an employee. POLICE SIDE. MAN'S EIGHTIETH CONVICTION. THEFT OF TOBACCO. Mr. W. G. Riddell, S.M., presided at the Police Court. George Hastings received his eightieth conviction. This latest addition to his record was for the theft of seven plugs of tobacco from tho shop of Wong Hop. It was stated that Wong Hop went out of his shop for a while, and on returning found Hustings helping himself to the tobacco. There was a scuffle, but Hastings's attempt to get away was finally settled by a policeman who appeared opportunely. OTHER CASES. . For insobriety, John William Lucas was fined 10s., Alexander Gilchrist 10s., and George William Jackson was committed to tho Roto Roa Inebriates' Institute for ono year. For having importuned, Kate Brady was sentenced to one month's imprisonment. For having broken a prohibition order she was lined £2, in default seven days' imprisonment. For having behaved in n threatening manner in a public place, Thomas AVatets was lined £2. K
