SUPREME COURT.

CIVIL SITTINGS CONTINUED. The civil sittings of the Supremo Court were oontinue'd yesterday, when his Honour tho Chief Justice (Sir .Robert Stout) was engaged hearing further evidonco in tho case, which opened on Thursday. The action arose in regard to a contract for the erection of a dwelliughouso in Hastings, Hawke's Bay. • Plaintiffs in the action were J. and A. Wilson, contractors, of Wellington. Defendant was Charles James Stanton Harcourt, land and estate agent, of Wellington. Mr. A. Gray, K.C., with Mr. D. S. Smith, appeared for J. and A. Wilson, while Mr. A. W. Blair appeared for the defendant. Litigation ,in connection with the matter extended',back to 1911, when the claim was first set down. From what iras alleged in the /statement of claim, it appeared that J. «ind A. Wilson had entered into a contract with defendant for tho erection of ii divellinghonso at Hastings at a ' contract price of .£I4OO. They claimed that in addition to the contract price they wero entitled to the sum of .£351 lis. lid. for extra works carried out, .£35 for preparing design etc.. and £3 3s. for inspection. Defendant (Harcourt) had paid tho sum ot .£1385 14s. lOd. but the sum 1 of JMltt 3s. Id. was still due, and for this plaintiffs (Wilsons) now sued. In the original defence it was urged that Harcourt had '.not dealt with Wilsons as principal, but in a special case, argued before the Supreme Court in December, 1911, it was held that ho was liablo as principal. . The action is still being defended on the ground that the contract was not completed as a whole, and hearing of evidence for tho plaintiffs commenced oil TJfflS-te sfesses. that Jura bp?n

oxamined so far havo given lengthy evidence, and tho hearing was still unfinished last evening when tho Court adjourn, ou until this morning.
