On the date mentioned, whilo in tho course ot her duties as housekeeper, she suffered an accident to her loft hand, whereby she has been, and still is, tot-ally incapacitated from earning her living. On. September So, Henaro Taaro M'Doimell died, and administration of his estate was granted to Katene. The latter paid certain moneys on account of compensation, but plaintilt (Ellon Thomson) now sued for a further sum of JGII6 12s. 6d. . By way of defence, Kateno denied that the plaintiff was pemanantlv totally incapacitated. Ho . expressed. his willingness to pay to the plaintiff tho sum £50, which he maintained was more tnan she was entitled to. . , Several medical witnesses were callcd on both sides, and after these had been heard, Mr. Justice Sim said that the Court was satisfied that the claimant had suffered a permanent loss of the um oi her left hand for all practical purposes. , Tho medical evidence and the appearand L of the hand supported that vi eTr ' claimant was therefore entitled to compensation on tho basis of permanent loss, and judgment would be (,'iven on that basis, it the amount could not be agreed on by the ' parties, the matter could bra mentioned ogadn.
