As it was stated that both parties vera agreed upon facts, Mr. Kettle, S.M., suggested that a declaratory judgment utider the Act of 1908 should bo obtained from a Judge of tho Supreme Court, whose finding would carry inoro weight than a magistrate's, particularly in other parts of the Dominion. Mr. M'Vongh, who appeared for defendants, agreed in this view, and the. case was accordingly shelved, so as to enable judgment to bo obtained if possible before the doso of the present Supreme Court sessions.
