' MOTION 'BY ME. ASQUITH, By Telegraph—Press Association—Copyright (Rec. April 22, 11.45 p.m.) . London, April 22. In the House of Commons tho Prime Minister, Mr. Asquith, moved that Sir Stuart Samuel's seat should be declared vacant. ' Sir Stuart Samuel is the Liberal member for tho Whilechnpel Division of Tower Hamlets, 'and is a partner in tlio firm of Samuel, Montagu and Co., which recently undertook it contract, at the request of tho Council of India, for the purchase of large - amounts of silver for tho Indian Government. He has been held by the Judicial Committee of the Privy Council to have come under Act 22 of George 111, which disqualifies contractors from serving in Parliament. Their decision is that ho must vacate his seat in the terms of the statute, which reads: "Any person who shall, directly or indirectly, himself or by anyone in trust for him, undertake any contract with a Government Department, shall Ire incapable of being elected, or of sitting or voting durinj* tho time'ho shall hold such contract or any sbaro thereof, or any benefit or emolument arising from tho same. A contractor sitting or voting is liablo to forfeit .ESOO for any day on which lie shall sit or vote." Since tho first purchases of silver were mailo in the spring of 1912 Sir Stuart Samuel has voted at least {10 times in the House of Commons, and he is, therefore, liablo to fines amounting to iCIG,SOO, in addition to vacating his seat.
