SERIOUS CHARGE.
AFFRAY IN WILLIS ST. MAN'S, SKULL FRACTURED, AN ARREST. Fitzgerald Chirk was arrested Inst eVPn»' ing by Constable J. Melville on a charge of and causiiiß grievous bodily harm io Kit ward Doherty in Upper Willis Street yesterday afternoon. The constable states that noting on instructions ho proceeded to Dr. M'Uavin's and there found Doherty in an unconscious condition with Dr. M'Gsvin attending him. Tho accused. Clark'was present, 1 alongwith Patrick Doherty, the injured man's brother. From what tho doctor finid and inquiries made the constable arrested Clark' on the charge mentioned, in reply to which Clark stated that Doherty hud used insulting words to him, but ho (Clark) did not menu to causo any "grievous bodily harm." . ■ ■ ■ Doherty was taken from Dr. M'Gavin'e to the hospital and up to a late hour had not recovered consciousness' Patrick Doherty, brother of the injured man, who eaid he came'from Hastings on March 1 and ■ liow resided ■ (it ii Reuben Avenue, Brooklyn, made a statement to tho effect that ho had met his brother about 1:30! p.m. yesterday and had visitwl two hotels, having it drink in each of them. When hornet his brother he would say that ho (the brother) had had a couple of drinks, but* was sober. About 4.40 p.m. they wore- both going up Upper Willis Street, to, sec a friend. llis brother had said Good afternoon" to the accused Clark, as they passed. Clark then called his brother aside and had a fevr words, but ho did not catch the tenor of their conversation.
The next tiling that li« saw was Clnrk stl'iko his brother twice. The first blow was a light one, but tho second knocked , his brother down. Dohcrty had not lifted his hands in self-defence. After his brother went down, ho did not move. Tho' accused and himself carried him to ono doctor's place (Dr. Gilmer's), but as ha was not in, they took him to J)r, M'Gavin's. ' . ' After-Clark called his brother aside, it was evident that they wer.o "rowing" about something, and seeing 4hat there was likely to Ijo a fight, he got between them. The accused then stepped to one side, and hit his brother. He was unablo to say : what Hie cause of the trouble was., Dr. M'Gavin said that the man was suffering from a fracture of the base of Ilia skull. When ho was brought into the; surgery tho man was bleding from two small wounds oil the outer end of the lcl't eyebrow. Edward Dohcrty is a married man rcsid.ing in Epuni Street.
