SUPREME COURT. .(Before his Honour Mr. Justice Chapman). The civil sittings of tho Supreme Court opened yesterday, More' Mr. Justice Chapman, who had to deal with a claim by William Nicholson, accountant, of Wellington, against David Taylor, butcher, of Wadostown, to recover tho 6um of £118 llis. 2<1., alleged to be due for goods sold. Plaintiff sued as receiver and manager for tho debenture-holders of the Banks Co-operativo Meat Distributing Co., Ltd., of Wellington. Mr. >H. F. Von. Haast appeared for Nicholson, while Mr. T. M. Wilford appeared for Taylor. Mr. Von Haast stated that he -understood that the point would be raised that Nicholson was not tho fight person to sue. If his Honour so decided,, counsel would ask permission to amend the claim by joining tho company or representatives of debenture-holders, as might be necessary. In the meantime he would call evidence;
After evidence had been, -tendered by the plaintiff (Wmr Nicholson), Mr. Von Haast closed his case, subject to the application mentioned above. Mr. Wilford raised the point that the plaintiff (Nicholson) had no right to sue because—(l) the appointment of Nichol'son as receiver had not been properly proved; (2) tho receiver, if properly appointed, had no power to sue in his own name; and (3) the proof of default in Clause 12 of. the debenture had not been placed before the Court. After hearing argument on these his Honour reserved decision.
IN DIVORCE.
A divorce petition, .Margaret Wcdder-e-popn y. Richard Wedderspoon, was heard in camera yesterday, before Mr. Justice Chapman, who granted a decree nisi. Mr. W. Sim appeared for the petitioner, and Mr. T. M. Wilford appeared for the respondent.
