A NICE POINT.

(APPEAL AGAINST DISMISSAL.

(By Telegraph.—Press Association.) . >' ' Dunedin, January 10. At tho sitting of the Tramway Appeal Board to-day (before Mr. Widdowson, S.M., and Messrs. J. J. Marlow and W. Belcher), George Lanborn appealed against v .dismissal from the employ of tho Dunedin apd Kaikoral Tramway Company for alleged continued disregard of gripinstructions with reference to f6 , passengers."Mrt<jlTwin appeared ,'for appellanVarid Mr." Stephens'for the \fompanr. i '" l Mr. 'Stephens said ho appeared - under protest, as ho wished to raise tho point ■ that there was no ground of appeal. An appeal only lay Vhero there had been dismissal for cause. Thoro wore two ways , of dismissali 'First, a week's notice on t either side. * Second, summary dismissal for good and sufficient cause. An employer 1 by tho award was giv6n the absoluto right to terminate nn engagement on a week's notice, and if there was right of appeal then the provision was qliite illusory, and the-Act created this position—that once nn employee entered the sorvico he was there for life unless he committed somo fault..

Mr. Irwin contended that if Mr. Stophoos's contention was correct, then the Act was a farce. He submitted that employees had a right to appeal in all ] fcascs, and unquestionably* whoro dismissal was in tho nature of a punishment. Mr. Widdowson said ifr. Stephens's was ft nice point, but the appeal would go on, and the board would furthel consider the matter after hearing tho'evidence. " . Evidence was then given by the appellant and other, employees, and Josoph Hunter, manager. Proceedings w«ro adjourned till Monday. ■ '
