M'Guire was engaged as secretary of,a bazaar committee., As the result of alleged nao by Maguire. of violent language lit tho bazaar. Hunter,)as president, wroto.asking him to ..resign. .On tho date of tho assault defendant -went; to, Hunter's-office' and .attempted to open negotiations;_bnt Hunter refused: to:talk ■with him. .Whilo plaintiff .was dusting his desk defendant ''lashed out, : and his ring out plaintiff's nose. 'Maguire' said: "I'll kill .you, Hunter." Witness's • nose bled freely. He rushed Maguire;from the offloe, andin tho passage , Maguire pioked :up a ohair and threatened "to bash out" witness's brains, 'He laid an 'Information.'
