Walter Krausch, alias Olsen, aged 17, a William Henry Eadcs, aged 17, Scddon 0 lteid, aged 18, and James O'Neill, aged 20, wero chnrged at tho Magistrate's Court yesterday with having (on the night of Sunday, December 8) broken and-entered into tho shop of Yco Waugh and Co. ond stolon the sum 0f;.£65-in money and ' 25 pockets of cigarettes, valued at 12s. 6d. "Edmund Walter. Dinnie, police finger- H 'print expert, stated that Detcctive-Ser- y geant Cassolls liad given him a certain ft tin for examination. He had compared '] a photograph of tho marks on it with a Sl copy of Krausch's finger-prints,, which had been sent to him from Auckland. The prints were identical. ■ n Detective Hammond 6tated that he had ij arrested Krausch. on December 27. j Kraiisch was, nt that time, in the company of one Spindler. and ho admitted that.Spindler was pajnug liis passago and taking him over to Sydney. They were _ to have sailed on the Maheno on' December, 16. Mun Dick (who,' with Hun Yung-, bis : partner, trade' under the namo of Yee • Waugh . and Company, and have their premises at the corner of Vivian , and ■ Taranaki Streets) was then called. He . stated that on the nigbt of Sunday, December 8, he was in Tiis shop till about , a quarter-past seven. He then prepared to go out, but,, just'as he was locking up, a young man came to tho back door | and asked him for cigarettes. Witness replied that ho did not have any, and tho young man went away. He then locked the door and went up the street. At that time there were nvo. shillings , (in sixpences and threepenny pieces) and five shillings (in coppers) in the till in , the shop. Upstairs ua a box in his own ■ room) he left X3O in .£B, in Jiiilf- ; sovereigns, and in silver, and £1 10s. in- coppers. The total amounted to iß6^.He identified the tin, handed into court I by the finger-print expert as being the one in which 1 lie was wont to keep Ws.nwer. coins. .When ho.returned (about 8.30)-lie found : his partner, Hun Yung, on the premises; and learned; that ihe shop-bod been broken into. Accompanicd by his partner, he went upstairs and, .found.;.that'.his. .box had been broken open.' From the stock in the shop '.he also' missed: 25 ..packets of . cigarettes and four tins of tobacco. . Hun Yung, the other partaer of .leo Waugh and Co., gave evidence similar to that of" Mun Dick. ' Wheii ike left the shop on Sunday night,' December 8, he left £3 of his own in a box in his room upstairs.-, He was aware, that his partner, who ; . managed the financial affairs, had JB62'of theirs in a ; box' upstairs. Ho returned to tho 6hop at about 8.15 p.m., and found tho doors broken open. , Elizabeth Sinclair, • housekeeper, knew the accused, and further said that 6hO had met Krausch on the evenjng of December 8, and that lie had said that he had got about from the Chinese; Md had divided it among "four fellows. :' • .; Thomas Ridout, a labourer,"also gave evidence. . . „ ; - Detective Mason gave., evidence as to statements made by th«" accused. tective-Sergeant Cassells,corroborated this . evidence as to' the statements. HO also identified the tin as that wlnch he-hai found on Mun Dick's bed after the theft had been committed. . ■ In his defence, Mr. Meredith said that the whole esse against O'Neill, Reid, and Eades lay iii their own statements. And theso statements : (argued Mr. Meredith) should liot be admissible; ' Apart from them, there was practically no eTidencc against tho accused. Thev; had been suspected before they made their statements, i,and they'had not been cautioned by the ; officers prior to making them. .In particular there was no caso at all 'Qgamst I ■ Roid and Eades.. v.'. ' • ' H's ' Worship:' said that. 'it was a case; of law : regarding the. statements, and remanded tne accused to the Supreme CJourt for trial. Bail wits allowed in the caao of Krausch and O'Neoll each, and in w£2o each for Reid and Eades. 1 further CHARGES. ; James O'Neill and Walter Krausch were further charged with breaking and entering, into the. shop of Andrew Beggs by night, and stealing 1 tin of biscuits. 201b. of- Derby tobacco, and 1 metal Watch, of:tho total value of 15s. Tho date was given as November 20. John Orr, manager for, Beggs, gavo evidenco as to tho the : illt.'ged theft, and as to goods •stolen. Ho. knew both accuscd; by sight.. . On the night of the occurrence,'-when ho was counting the cash, and he looked, through the window,, he saw ONcill pull■■ his hcaid back, as if he had been watchint through the .wind 9 w: . -Elizabeth Sinclair, giving evidence in this case, said she had overheard Krausch and Ridout' talking about tho K.bacco, a , and on Monday ci man called for the tobacco, and took it away.
