SHARP CRITICISM BY A JUDGE. By Tcleerapli—Press Assooiaition-OopyrigM Melbourne, December 6. During tie hearing' in. the Arbitration Court of the Brisbane Tramway Company case, Mr. Justice Higgins asked the Company's counsel to state what the future attitude of the company would be towards unionists; Counsel replied that the company could not undertake to discriminate. Mr. Justice Higgins said that unless the company would undertake to discriminate lie would be driven to take a stronger course in granting preference. Tho company's union was formed .to draw away members from the Tramway Employees' Association, and he would only grant the men preference- because the men were unable to protect themselves otherwise. Counsel contended' that there was no dispute, and therefore there was no longer any interest in obtaining an award. He left the responsibility with Mr. Justice Higgins. ■ ' • , The Judge replied: "Tour position is this—you resist the award, you resist the union, you oppose everything, and won't ooneent to anything," ■
