NOTICE OP SPECIAL ORDISE. .• Notice is. hereby given that at a Special Meeting of the Council of the City of Wellington, held on the 11th (lay of November, 1912, it was resolved us follows:— WHEKEAS, by Deed of Lease dated the Gthday of November, 1905, Registered No. 92270, made between tlio Mayor, Councillors, and Citizens of the City of Wellington, and Frederick George Boltoij, the land described in the said Deed of Lease being parts of Sections 12,1 and 124 Lambton Reclamation, ivas leased to tho said Frederick George Bolton for the term of 21 years from the first day of March, 1905. AND WHEREAS, by Deed of Assignment dated the 19th day of June, 1907. Registered No. 9(>570, the said lands became vested, in John Fuller, Benjamin John Fuller, and John Fuller, the Younger, for the residue then to come and unexpired of the term of years created by the said Deed of Lease registered No. 92270, AND WHEREAS, by Deed of Lease dated the 25th day of March, 1908, Registered No. 98549, the Mayor, Councillors, and Citizens of the City of Wellington leased to tho said John Fuller, Benjamin John Fuller, and John. Fuller, the Younger, the lands comprised in tho said Deeds of Lease, being Sections 120, 121, 13D, and part of Sections 123 and 124 Lambton Reclamation, for the term of six years from the first day of January, 1908, AND AVHEREAS, by . Deed of Lease dated the 28th day of January, 1911, Registered No. 105492, the Mayor. Councillors, and Citizens of tho City of Wellington leased to the said John Fuller, Benjamin John Fuller, and John Fuller, the Younger, the lands comprised in the said Deed of Lease being Section 122, Lambton Reclamation, for the term of three years from the first day of January, 1911, AND WHEREAS the said John Fuller. Benjamin John 'Fuller, and John Fuller, the Younger, have requested the Corporation to accept a Surrender of tho .said three leases of the said lands, and to grant new leases thereof to them, the surrenderors, in the manner for tho terms and upon the covenants, conditions, and provisions hereinafter appearing. NOW THEREFORE, the Wellington City Council, in pursuance and exercise of the powers vested in it by "The Municipal Corporations Act. 1908," and all other powers 'enabling it in this behalf, doth here- - by resolve by way of Special Order:— 1. To accept a surrender of the said three De?cls of I/ease, Registered Nos. 92270, 98849, and 105,'492, and to grant to the surrenderors new leases of the lands comprised therein, as follows:— (1) A new lease of all that pigce of land, being parts of Sections 120 and 122 Lambton Reclamation, bounded on the North by Waring Taylor Street, 25 feet on the West by Sections 119, 118, 117, 116, and 115 Lambton Reclamation, 170 feet 5 inches, on the South by Johnston Street 25 feet, and on the East by other parts of the said Sections 120 and 122, 170 feet as the said piece of land is more particularly delineated on the plan hereto appended and therein edged red and marked "Lot 1." '

(2) A nw lease of All that niece of. land, being Sections 13G, 12i, 123. and 121, and parts of Section 120 and 122, Lambton Reclamation, bounded on the North by Waring Taylor. Street 70 feat, on the" West by other parts of the faid Sections 120 and-122. 170 feet. .on the South by Johnston Street 70 feet, and on the East by Sections 135 • •and 125, Lambton Reclamation, • 170 feet, as the ea'd piece of land i« "inra particularly delineated on the said appended Plan, and is therein edged blue and marked "Lot 2." (3) The terms of the paid leases to be one year from Ist January, 1913. 2.. The new leases shall contain a ' covenant for the granting of renewals ' of the said' leases in perpetuity, at 1 an annual rental to be .fixed' by valua- \ tion' of the full and improved ground I rental of tho said premises that ought I to be payable dnring such new term, ' without'talcing into consideration the value of. any. buildings or. improvements then existing un the demised premises for successive periods of fourteen years, and such leases shall con- . tain tho same covenants, mutatis :mutandis, as are contained in- leases j' of the Te Aro-Reclamation now grant- ' od by'.tho Wellington City Corporation. 4. The new lease of the said Lot 1 shall contain a covenant to erect oil the said land before the first day of July, 1015, a building of the nature and in the manner set out in tho said leases of tho Te Aro Reclamation. 5. Tho new lease of the said Lot 2 shall _ contain a covenant to . erect a building on the said land .before ,the first day of October, 1913, of the nature and in the manner set 'out in the said Te Aro Reclamation Leases. G. The form of the said new Leases and the covenants and provisions therein shall 'be settled by the City Solicitor. 7. Thtf surrenderors : shall nay all costs and charges incurred in the pre-( paration and advertising of this special order, and shall also tray all . charges and costs in connection with the preparation and execution of the said new leases.'
