MAGISTRATE'S COURT.

(Before Dr.-.M'Arthur, S.M.) AGED HOUSEBREAKER. George Lee, 70 years of age, pleaded guilty to a charge of having broken ami entered the residence of Captain Blackburne, in Hawker Street, and a charge of having had housebreaking tools in his possession. Ho was committed to the Supreme Court for sentence. It was alleged th.it l.ee had stolen XX 15s. 9d. from the residence. SUBSTANTIAL- FINE. ■ William Savage was fined £'ii for having sold liquor without a license. Accused, who was represented by Mr. 11, F. O'Leary, pleaded guilty. BANKRUPTCY ACT. Edward Wilfrid Jacobs, who was represented by Mr. P. H. Putnam, pleaded not guilty to two charges of breaches of the Bankruptcy Act. The alleged offences were that, at the time when he contracted curtain debts, he did not have reasonable expectation of being able to pay; also that he endeavoured to concenl the true slate of his.affairs by wilfully omitting to keep proper liooks or accounts. Chief-Dotective Broberg conducted tho case on behalf of tho police. The Official Assignee (Mr. A. Simpson) stated in evidence that accused had been adjudicated a bankrupt on July 18, 1810, The books handed m by bankrupt were.

incomplete, and so it was not possible to arrive at the true state of liis business.

Ho thought that accused must have kept other books than those produced. Tho accused reserved his defence, and was committed to tho Supreme Court for trial. Bail was nllowed in his own surety of .£IOO, and two sureties of M 0 each.

MILKING MACHINE. Further evidence was 'heard yesterday [in tho case in which J.'B. MacLwan and Co., Ltd., Wellington, claimed i-i(> 3s. Sil. from W. li. Goodriek, farmer, Eeilding, for hire and insurance ol' a milking machine and for accessories to the milking plant. The rato of hire was .£2O per quarter. Defendant Goodriek eounter-claiineil for ,CI(10. He stated that the machine had failed to milk his cows, although plaintiffs had warranted that it would perform its work satisfactorily. The effect of the machine's failure had been to dry off tho cows several months earlier than usual, through which, ho said, he had sustained monetary loss. He therefore claimed .£IOO damages,_ and he sued for the return of his deposit of .£6O. Mr. F. G. Dalziell appeared for tie plaintiff, and Mr. T. N. Holinden for.the defendant. His Worship adjourned the case until Friday afternoon next.
