Chief Justice tSir Robert Stout), Mr. Justice Williams, Mr. . Justice Edwards, llr..Justice Cooper, aud-Mr. Justice Chapman. Hearing of the case commenced on Monday,' aid-an outline of the circumstances surrounding it' was published in' yester-day-Is .issue. • The area involved was. the siiare of the late Huru te Hiaro (ono ,of five holders) iri 728 acres 2 roods 12 perches.,' Over a dozen questions were submitted to .the Supreme Court, 'the'principal being: (1) AVhother Huru "te Kiaro's iands were capable of being devised,' (2) Whether the will, of which probale had been granted, or the .succession order, inconsistent therewith,' should prevail,' (3) whether the Chief Judge had power to annul tho succession order made, by Judge Butler.' . Mr. H. D. Bell, K.C., with him Mr. H. F. Ayson, appeared for the Public Trustee (executor of the will of Karepa-Waata, one of the devisees of tho interest of Huru te Hiaro). Sir John Findlay, K.C'.j with him Mr. D. M. Findlay, appeared for the Public Trustee (trustee for the infant children of Hetariki Jlatao, an ' interested ■ party)./ Mr. ,P. E. Baldwin, of Palmerston North,' appeared for Maihi Hangina,. another interested party, while Mr. H. H. ■' Ostler, of the Crown Law Office, appeared for the-Registrar-General of JLands. Argument concluded , at'3.3o p.m. yesterday, when the Court reserved decision.
