CIVIL ACTION,
I (Before Dr. M'Arthur, S.M.). THE LANDAU AND THE MOTOR. Edward Morris, junior, undertaker, Wellington, sued C. Russell, motor-ear proprietor, Christchurch, for ,£BS 75., as damages arising out of a collision betwocn a landau and a motor-car at the corner of Wellington Terrace and Bolton Street, on tho night of July 19. Tho details of the amount claimed woreRepairs to landau, ,£3l 75.; depreciation in value of landau, ,£3O; loss of use of landau while it was being repaired, damage to the driver's clothing, £5; and injuries and shock to tho driver, £5. Mr. V. R. Meredith appeared for the plaintiff, and Mr. P. J. O'Regnn for the defendant. The defence was that the accident was inevitable and that defendant could not have avoided it. His Worship reserved decision.
