POINT IN DEFENCE ACT.
(Bj Teleztaph—Roecial Correspondents Christchurch, July 25. In the case in which a young man was charged with refusing to take the oath of allegiance, a point was raised that the terms of the oath were illegal. The argument of his counsel was that Section 11 of the Defence Act laid down the oath definitely and clearly, and that this was the only oath that could bo offered. The Defence Department had added a number of words to the oath, and it was that oath (with these additions) that was offered to defendant which tho defence submitted was illegal. In ono place the words had been added, "I will observe and obey all orders of his Majesty and heirs and successors, and of generals and officers set over me." Counsel submitted that there was no power for theso additions. This point was row being considered by the magistrates in Kelson and Auckland. The Sub-Inspector said that, in his opinion, the point required consideration. He did not know of aßy authority for additions to the oath. His Worship took time to consider the point
