MAGISTRATE'S COURT.

CIVIL ACTIONS. DISPUTE OVER COMMISSION. At tbo Magistrate's Court yesterday William Alexander Thomson, who carries on business as a commission agent under the name of Thomson and Brown, sued Thomas George Macarthy. brewer, for ,£3B Ins. as commission on the sale to Mr. Fauvcl lor J11350 of a house on Wellington Terrace, formerly owned by Mr. P. Heyes. Mr. 0. Beere appeared for the plaintiff, and Mr. J. J. M'Grath for 'the defendant. After evidence for plaintiff had been heard, Mr. M'Grath submitted that plaintiff ought to bo nonsuited. Counsel contended that plaintiff had been employed by Mr. Heyes, and not by defendant, and that, therefore, the commission was not owing bv defendant. His Worship reserved the point, and arranged to hear evidence for the defendant on Wednesday afternoon. "UNDEFENDED CASES. JUDGMENT SUMMONSES. / William Neville Ward was ordered io pay Julius Holtz ,£lB os. 3d., in monthly instalments of 10s.; and P. Taylor was ordered to pay Dalgety and Co., Ltd., ,£2 3s. lOd. by May 23. POLICE BUSINESS. THE HOKITIKA CASE. Hearing of evidence in the case in which James Wilson and Albert Cutbush wero charged with having forged the name of E. It. UoWiison.to a cheque for .£2O lis., and uttered tho cheque to Ernest Batchelor, was concluded. JO. H. Robinson, manager and auctioneer for the firm of Mark Spratt, Hokitika, deposed that some time ago a cheque had been made out in the office by one of the clerks, and when it had been given to witness to sign he had discovered an eiror in it. He had handed v the cheque and tlie account back to the clerk for a cliequo form to be filled in correctly. Tho form which had been wrongly filled in should have been destroyed, but, apparently, had been left about. That particular form had never been signed by him. The signature on the cheque form produced in court was not his, and had not been written by any employee of tho linn. The writing resembled writing Cutbush had done in the linn's wages book. Cutbush had been employed casually by Spratt, and had done one day's work thero since the cheque form mentioned had been wrongly tilled in. The defendants pleaded not guilty. They were committed to tbo Supreme Court lor trial. Bail (JCSO) was allowed. OTHER CASES. Catherine O'Connor was found guilty of having importuned two constables (in plain clothes) in n public street. She was ordered to appear for sentence when called on, on condition that she. went to tho Salvation Army Homo for three months. „„ „ , . David Taft was fined X 3' for having broken his uroliibition order.
