"VTOTICE IS lIIiREBY GIVEN that at a Special Meeting of the Council of the Citv of Wellington, held on tho • 1-th day o'f March, 1912, it was resolved (is follows:— UHEREAS by Deed of Lease dated the 30th day of October, 1872, registered No. G7360, the Mayor, Councillors, and Citizens of the City of Wellington leased to the Public Hall Company, Limited, inter alia, Sections 115, 11G, and 117 Lambtou Reclaimed Land, for tho term of 42 years from the Ist day of January, 1872, at tho rental and upon nnd .subject to the covenants and conditions set out in tho said Deed of Lease, AND WHEREAS by Deed of I.ea=e dated the : 17th day of January, .1902, Registered Number 82370, the Public Hall Company, Limited, leased : parts t'f the said Sections to Reuben Shallcrass Baker for the term of 10 years and eleven months from the Ist day of January, 1902, AND WHEREAS by Deed of Assignment, dated the 23rd day of May, 1907, Registered Number 9G504| the said lauds l>eeamo vested in John Fuller, Benjamin Fuller, and John Fuller, the younger, for the residue then to come and unexpired of the term of years created by the said Deed of Lease, Registered No. G73GO, AND WHEREAS the said John Fuller, Benjamin Fuller, and John Fuller the younger, have requested tho Wellington City Council. to accept a surrender of tho said lease, Registered No. G73GO, and to grant a new lease of the said lands to them. NOW. THEREFORE, the .Wellington City Council, in pursuance and exerciso. of the powers vested in it by "The Muni-" cip.nl Corporations Aet, 1008," nnd all other powers enabling it in this behalf, doth hereby resolve by way of Special Order, • To accept a surrender of the saiid lease, Registered No. 67360, in so far as the same affects the said Sections 115, 11G, and 117 Lambton Reclamation, subject to the said sub-lease, Registered No. 82370, and to grant a new lease of the said lands to the surrenderors for the unexpired portions of the term of years created by'the said Deed of Lease, Registered No. 67360, at the rental and upon tile terms, and conditions following:— 1. The present rental shall be increased from .£63 lGs. per annum to .£1066 16s. 9d. per annum, payable in advance as herein after provided for the balance of tho term created by tho said Deed of Lease, sneh new Lease to run from the Ist day of May, 1912, the first payment of rent, .£177 16s. +d., is' to be paid on the execution of the lease. The rent thereafter is to be payable in three* halfyearly instalments-of .£533 Bs. 4d. on Ist .Tulv, 1012, Ist Januarv, 1913, and Ist July. 1011. 2. The new lease shall contain a covenant for the granting of renewals of the said , lease in perpetuity at an annual rental to be fixed by valuation of the full and improved ground rental of the said premises that ought to bo payable during such lien- term without taking into consideration the value of any buildings .or improvements then existing on the demised premises, for successive periods of fourteen years, and such lease shall contain the. Vaine covenants mutatis mutandis as are contained in leases of the Te Aro Reclamation, now granted by the •Wellington City .Corporation. : 3. The said lease shall contain a covenant for the insertion of a covenant in the first renewal of the said lease in 1915, but in no other renewal to build oil the said land within eighteen months of the expiration of the term of the said new leiise, '3 of at least three ' stories in height, in compliance with the By-laws for the timo being in force in the City of Wellington. •1. The said new lease shall contain covenants by the Surrenderors to do all things necessary to keep in force tho Hotel License granted in respect of the existing hotel, on tho said premises ,ns shall lje required by the City Solicitor. .. 5.
