Clt - V nf Wellington, held on tho 12th day of March, 1912, it was resolved as follows:— WHEREAS by Deed of Lease dated tho 30th day of October, 1872, registered No. 87380, tho Mayor, Councillors, mid Cities of the City of Wellington leased to tho Public Hall Company, Limited, inter alia, Sections 115,. 118, and 117 Lambton Reclaimed Land, for tho term of «years irom tho Ist day of January, 1872, n't tho rental and upon mid subject to the covenants and conditions set out in tho said Deed of Lease, AND WHEREAS by Deed of Leaso dated the 17th dav of January, 1302. Registered Number 82370, tho Public Hail Company, Limited, leased parts of tho said Sections to Reuben Shallcrass Baker for the term of 10 vcars and eleven months from the Ist day of January, AND WHEREAS bv Deed of Assignment, dated the 23rd day of Mav, 1907, Registercd Number 96501, the said lands became rested in John Fuller, Benjamin Fuller, and John Fuller, the younger, for tho residue then to conio and unexpired of tho term of years created bv tho said Deed of Lease, Registered No. 873C0, AND WHEREAS the said John Fuller, Benjamin Fuller, and John Fuller the younger, have requested the Wellington City Council to accept a surrender of tlio said lease, Registered No. 67330, and to grant a new lease of tho said lands to them. NOW, THEREFORE, tho Wellington City Council, in pursu'anco and exercise of the powers vested in it by "The Municipal Corporations Act, 1908," and all other powers enabling it in this behalf, doth hereby resolvo by way, of Special Order,

To accept a surrender of the smid lease, Registered No. 67300, in so far as tho same affects the Raid Sections 115, IMS, and 117 Lanibton lieclanintion, subject to tho said sub-lease,' ltcgistered No, 82370, and to grant a new leaso of the said lands to tho surrenderors for' the unexpired portions of the term of years created by tho said Deed of Lease, Kogisterod So. 67360, at the rental ami upon, tho terms, aiid conditions following:—

1. The present rental shall be increased from J2GS lfis. per annum to .CIOGG 10s. !)d. per nnmim, payable in ndvanco as herein after provided for tho balance of tho term created by (ho said Heed of Lease, such new Lease to run from fho Ist day of May, 1912, tho first payment of rent, ,£177 lfis. 4(1., is to bo paid on tho execution of the lease. The rent thereafter is to be payable in three Halfyearly instalments of J!533 Bs. id. on Ist July, 1912, Ist January, 1913, and Ist July, 19U.

2. The new lease shall contain a covenant for tho granting of renewals of the said leaso in perpetuity at an annual rental to he fixed by valuation of the full and improved ground rental of tho faid promises that ought to bo payable during such new term without taking into consideration the value of any buildings cr improvements then existin? on tho demised premises, for successive periods of fourteen years, and such leaso shall contain tho same covenants mutatis mutandis as aro contained in leases of the To Aro Rrclaniatiou, now granted by tho Wellington City Corporation. 3. Tho said lease shall contain a covenant, for tho insertion of a covenant in the first renewal' of tho said leaso in 1915, but in no other renewal to build on (ho said land wilhin eighteen months of tho expiration of the term of tho said new lease, a building of at least throe stories in height, in compliance with tho By-laws for the time being in foroo in tlio City of Wellington. 4. Tho said new lease _ shall contain covenants by the Surrenderors to do all tilings necessary to keep in force tho Hotel License granted in respect of the existing hotel on tho said premises as shall 1» required by tho City Solicitor. 5. The Surrenderors shall pay nil the costs connected with, the granting of tlio said new lease, including tho cost of nreparing and advertising this Special Order. 6. Tho terms of the said new leaso shall be fixed by the City Solicitor. The abovo Resolution will be submitted for Confirmation nt an Ordinary Meeting of tho Council, to bo held on THURSDAY, tho 18th day of APRIL, 1012, at 8 I p.m., in tiro Council Chamber, Town Hall, Cuba Street, Wellington.
