WHOSE CHICKEN? REARGUARD ACTIOX FOI'GHT. IX A BACKYARD. Cases arisinj! out of- a dispute between two neighbouring families were heard at tho Magistrate's Court yesterday morning. Stanley Masters and Charles Masters were charged with assaulting Mrs. Mary Ann Daly, Stanley Masters with assaulting Joseph Daly, Mid Joseph Daly with assaulting Henry Masters. Mr. L'. .7. Fitzgibbou appeared for the Dalys, and Mr. A. K. Atkinson for the -Masters. As all the charges a.rose out of tlin. same set of circumstances, they were heard together. February I" was" the date of tho trouble. Evidence was given by Mr. and Mrs. Daly and their two daughters, and by Mr. Henry Masts, "s and his two sons. The Dalys said, in effect, that Mr. Masters and his son, Charles, went into their "place" and proceeded to the fowlyard, where Charles ila'lers caught up one of the chickens. .Mrs. Daly remunerated with him and asked him to let go the fowl "as it was not his." She also asked him to go out. He said that he would leave when he pleased. She endeavoured la take the fowl from him, and he struck her in the face. Then Stanley Masters came on the scene, and threw lier husband against the fence. Then the two young Masters got hold of her husband. Stanley Masters kicked her. She still had the fowls, and thev were hers.

The Masters, witnesses declared, in their evidence, that the moment they were ] told to go, they recognised that they had to do so', and they prepared to leave. They "fought a rearguard action all the way' in order to protect their retreat." Mrs. Daly was not struck, but had to be pushed aivay, as she was militant. Mr. Daly brandished a shovel.
