MOTORS. BY-LAWS, AND SPEED.
COUNCIL'S 'HOST CASE, Sty Asßecio.Hon.l Hamilton, February 5. 'flic magistrate (Jli , . Loughmui) to-day gave judgment in a test rase, Hamilton Borough Council v. Bates's Motor Garage, for breach of the council's motor by-law by exceeding the speed limit of eight miles an hour.
The deleiidant pleaded not guilty, though admitting that ho luul exceeded the speed mentioned. His counsel conteiuled that the by-law was unreasonable.
In reply to the S.M., as to whether he could not go (juicker than a hansom cab, defendant said: "Quicker in wheelbarrows." (Laughter.)
After ji mass of evidence in favour of defendant, had l)een given by motor-car owners, his Worship commented on the fact thut the borough had no representative present. He considered that the enso should have been taken out of the hnmls of tlie police, as it was n matter of defending their own by-laws. Then 'costs could have been awarded. It was unfortunate for the man who had thrown himself into the breach in order to set the bylaw rnm-olled. At the conclusion of a lengthy judgment, his Worship said that because it was thought that the by-law was unreasamiblp ho would indict no penalty. If the police decided to appeal against that decision he would put it in writing.
