(Before Mr. W. G. liidcicll, S.M.) THEATRE INCIDENTPATRON IS BROUGHT TO COURT. FIXED. A charge of 'having disturbed, an audicuco at the Theatre lioval was made against John O'Brieu. Evidcnco in support' of ths charge vas given, by-employees at Hie theatre. Defendant O'B'rirn contended that ho had created no disturbance. A nuinber of witnesses swoio that O'Brien was not guilty of. having made any., disturbance. - His Worship observed that tho management of the theatre had allowed a. certain amount of license, which had made the entertainment somewhat different from other performances. He thought, however, that the defendant ought to be convicted, but, ns the management hat! it in their own hands to cantrol their audiences, a heavy penalty lsis not necessary. Mr. E. ,T. Fitzgibbon, who appeared for O'Brirm, stated that the reason why his client had defended the cafe was to prevent a conviction, for a conviction mipht mean a good deal to him ■(defendant'. Would his Worship use the powers which he had under the J.P. Act, and dismiss _ tho information? The purposes of the prosecutors would be sirved without a conviction. His Worship declined to meet this request, but remarked that defendant was no doubt unfortunate. A tino of 10s. was imposed. DISORDER AND ASSAULTS. John M'Conville was fined £2 for disorderly conduct whiln drunk, £2 for assaulting Constable Hardy, and £2 for assaulting Elizabeth Scott. It appeared from thn proceedings that M'Conville had been taken to Mrs. Scott's residence by a man who boarded there, and, according to Airs. I'icott. ho had misbehaved, and had been ordered to leayn the premises. Before going he had hit her. ■ Evidence was also given that defendant- had kicked Constable Hardy viciously. M'Couvilln denied both ass."j,lts, and pleaded for a. chance to "turn over a now leaf," but lines were imposed 2,s stated above. DESERTERS. ; Richard Allen and Henry Stevenson were each sentciced to one month's ini- _ prisonment for dssertinr; from s.s. W.'iimate.
