SUPREME COURT. THE CHEF AND HIS GRIEVANCE. TEA ROOMS CASE. Mr. R, Kennedy (8011, Gully, Bell, and Myers) appeared in tho Supremo Court yesterday in support of a motion by defendants to dismiss tho action A. P. M.hjo; v. Blundell Bros., Ltd. This was an action to recover the sum of .£5Ol damages for alleged libel, and concerned a paragraph that appeared in the "Evening Post" in reference to Carroll's 'I'ea Rooms, Wellington, and which was said to have reflected on the plaintiff (Major) who was a chef at the tea rooms. Before tho main action came on, plaintiff asked to have certain points of law settled by stating a special case. This, however, was not proceeded "with, and, yesterday, defendants (Blundell Bros., Ltd.) moved to dismiss the action. Tho motion was not opposed, and the Chief Justice (Sir Robert Stout) dismissed the action with costs according to scale to bo fixed by tho Registrar, and to include costs of preparation for tho trial. THE WAIWETU CASE. In the Supremo Court yesterday afternoon, before tho Chief 'Justice (Sir Robert Stout), argument was heard in tho case in which Eleanor Thorns proceeded against Edith Dorothy Ellis and John Ellis to recover the sum of .£SOO, alleged to bo .duo as damages for injury to plaintiff's property, caused by defendants having erected a dam in the Waiwotu Stream. Plaintiff also asked for au injunction to restrain defendants from causing further damage.
Mr. A. W. Blair appeared for plaintiff, and Mr. C. B. Morisoa for the defendants. Evidence had been taken on Thursday on the question of leave and license, and argument was concluded yesterday. Decision was reserved.
