« THE KOPAATUAKI BLOCK. Yesterday, Mr. .Tus-tico Sim delivered .the judgment of the Court of Appeal in the matter of a summons to tho District Land Registrar at Gisborne to show cause whv lie should not register a transfer of the leasehold interest of R. IT. L. Oldfield, of To law Bay, sheep-farmer, in tho Kopaatuaki Block, of 140(1 iieres, in favour of N. 51. Fulton, of GMi.irno, shwp-farmcr. The refusal "f the registrar was on the ground that the transferee was barml by Section 193 of the Native. Land Act, 1000. as it exceeded acres. The objection was not that the land could not be transferred to Fnllon, but that it could not be trausferred to anyone.
Tlin Full Court by a majority decision (Justices Edwards and Chapman for, mid Sir Kohort Slont) ordered the. registrar in ropistpr (he transfer. The rrmvn npliealcd. Mr. J. AV. Salmoml (SolicitorOnoral) appeared for the appoilnnt. and Mr C B. Morion and Mr. .1. W. Nolan for Mr. U. H. L. OldfioM, the respondent. The appeal was dismissed. Conditional leave was srantod the Crown to appeal to (.he Privy Council.
