IMPORTANT SHIPPING CASE, An important shipping cose involving tho steamer Lauderdale cam© uo for hearing at tho Water Poiico Court. Sydney, re« ccntly. It appears that three seamen oolonging to the Lauderdale were charged with deserting her in Tasmania. It .was .alleged for the defence that the ship.'which was loaded with dcck cargo, had no taroaulins over the hatches, and was. therefore, unBeaworthy. The sccrcta-ry of the Seamen a. Unionstated tha,t. in his opinion, if a shiu went to £?ca, with tart>a\Llin3 off the hatches she would not be in a seaworthy condition. If the timber were stacked to a height of 6ft. on the hatches he would say it would not ho pet-artrabJe in case of urgency. In a heavy sea, the timber would, in all probability. shift itself. The object of tho tarpa.ulins was to prevent the water from getting down the hatchways and to maho tho hatches secure. For the prosecution it was stated that the Lauderdale was in a seaworthy condition. The hatch was 4ft. above the main dook where the load lino was taken from. and in addition there was a combing of 2ft. 6in. around the hatch. Even if water did percolate from the hatch into the hold, it wa-s still held that the vessel v.n3 in a seaworthy condition. TUe captain of the Lauderdalo said ho supervised the le-ading of the vessel at Port Iluon, being on deck most of tho time.' The Lauderdale was what \va3 called a. "well-decked" ship. He thought the bulwarks were 3ft. 4in. high. The two io/ward hatches on the woll deck wore securely battened down. The shin took water on the forward dock, but from the time Bhc was built never did more than take spray on the after deck, even when coming from deeply laden. The assessor to the Marine Board txprcswd the ooinion that the vessel would not bo in a seaworthy condition with 4ft. of timber slacked on the hatches. One of the cievv stated, in evidence, that he had drawn the captain's attention to tho fact of tho hatches beir.z uncovcitd, and had stated that the-master had torn him to go forward and "mind his own business."

In giving his decision, the magistrate said that ho had come to tho conclusion that tho shin was not seaworthy at tho time mentioned, and, therefore, the defendants' refusiil to go to cea was r.ot desertion. Tiia charge wculd be dismisi>ed with co«;ts the prosecution in each case. The magistrate a!=;o ordered the captain to pay the men wages due, or in default imprisonment for 21 days. The amounts together with costs, were ordered to be paid net later than 4 p.m. on September 20; and if tinned Uy that time, the balance unpaid to be levied by distress or poinding and salo of ship, tackle, furniture, and apparel.
