THE JULIAN APPEAL.

CASE MUST BE RE-OPENED. (By Telesraph.—Press Association,! Christchurch, Juno 21. In the matter of the appeal of Julian, a jockey, against, his .disqualification on a charge of wilfully, pulling Napper in the Kaitoke Hack Hurdles, the judges appointed by the Racing Conference reported that objection to Julian's riding the horse Napper in the Kaitoke Hurdles on May 21 was made by the stewards of the Wanganui Jockey Club on their own motion, and that the ground was that the jockey had not'used, his best endeavours to win the race. A meeting of the stewards was called to consider whether or not the jockey had properly ridden tho horse. In these circumstances it was tho plain duty of tho stewards to notify- the jockey of tho nature of the charge, in order to afford him an opportunity to hoar tho evidence and to defend himself by calling evidence in liis own behalf. Theso requirements, which were essential to the just administration of the racing laws, had not been observed. The judges continued:—Wo to© of opinion, that the inquiry was irregularly conducted, and that tho decision of tho stewards cannot be regarded as a valid determination and objection, and must be set aside. Wo direct that tho matter bo remitted to tho stewards of the club, so that they may notify the jockey of the specific objection against him, and tho time and place where such objection shall be hoard and considered. Without indicating an opinion as to the merits of tho case, which have not como under our consideration, but solely to guard against possible injustice, we direct that tho disqualification of Julian be suspended, and is .inoperative until the charge against him is regularly dealt with by the stewards of tho AVanganui Club.
