THE ISITT LIBEL ACTION.
A SETTLEMENT AND WHY MR, ISITT SUED. (By Telegraph-Press Association.! Christchurch, June 17. A settlement lias been arrived at in the libel action, L. M. Isitt' versus J. M. Stewart', as follows:—The jury awarded .CSOO damages, subject to the decision of his Honour the Judge on questions of law raised at the trial. The defence pleaded that tho publication of Mr. Isitt's name in the "Trade List" was privilog- | ed, and (hat members of the Association were entitled to acquaint one another with the name's of persons who were entered in the list, which list was circulated among its members. The Judge reserved his decision on the question of privilege, and no damages would have had to be paid by defendant to plaintiff until the Judge had delivered his decision on that point in plaintiff's favour. •
In (ho meantime (he member of the Association who gave Mr. Isilt's name for insertion in the "Trade List" has arranged will] Mr. Isili to pay him .EIA, and both his and defendant's costs in consideration of Mr. Isilt abandoning any verdict which he might obtain, also refraining from Liking any proceedings against.' the said member. This course Mr. Isitt agreed to as he had brought the action for the purpose of the clearing of his.character and credit, and not for the purpose of obtaining heavy damages.
