For failing to send in the nccessary returns to the Registrar of Companies, the Taihape Dairy Co-operative Company, Ltd., was lined 205., with costs 7.-., and solicitor's fee ,£1 Is. Mr. T. Neavo appeared for the Registrar of Companies. Alfred John Slack, who did not appear, ■was lined 20s. and costs 9s. for keeping his shop in Riddiford Street open for the purpose of trading on Sunday, June 4. Default was fixed at 1 seven days' imprisonment. For allowing a horse to wander in Customhouse Quay, H. Doherty was lined ss. and costs 7s. J. 'feitclblatt, who admitted leaving a tram-car while in motion, was convicted, and ordered to pay 10s. Gd. medical expenses, and 15s. Court costs. It appeared that defendant had been slightly injured, and had to bo attended by Dr. Tolhnrst. Mr. Beechey appeared for the City Council. May Ander-on was granted remission of arrears duo under a maintenance order, tho, further payments under the order to bo suspended for two weeks. A first-offending inebriate was fined ss„ with the alternative of 21 hours' imprisonment. CIVIL BUSINESS. ■ (Beforp Dr. A. M'Arthur, S.M.) Hearing was concluded yesterday of the civil case in which tho Commissioner of Taxes sued the Eastern Extension Australasian and China Telegraph Co., Ltd.. to recover the sum of ,£7l 3s. 10c!., alleged to be duo on account of taxes unpaid (.£O7 95.) and interest thereon at 10 per cent. (<£6 Is. 10d.). Defendants counterclaimed .£67 9s„ alleging that on August 23, ISO!, defendant? obtained judgment against the plaintiff for the refund of certain incemo tax paid by defendants, and costs to bo fixed by tho Supremo Court. These costs were subsequently fixed at .£lB5 2s. 9d., and . settled . about September 20, 1910, and the defendants were entitled to interest thereon at 6 per cent, from August, 1001,' to September, 1910, this interest, to ,£G7 !).«. The defendants' had ; .'inec received a bill for, income ■ taxamounting to .£l3l 10sl fid.;'vpaying .£O7 Is. 6d„. and taking credit for the sum 0f.,£07 Bs. The sum so paid, together with the amount credited, made up the whole amount, payable by tho defendant to (ho plaintiff for such income tax as aforesaid. Therefore the penal rate at 10 per cent, (amounting to _t-6 lis. lOd.) never bccame due. Mr. T. Neavo appeared for plaintiff, and Mr. A. W. Blair for defendant. Decision was reserved.
