COURT OF APPEAL.
THE FOXTON HOTEL CASE. ONE SMALL STAGE OX. Argument re ?ale of AVhyto's Hotel, Foxtail, went on yc.-terday beforp the Chief Justice (Sir Jtobert Stout), Mr. Justice William?, Mr. Justice DemiUlon, ami Air. Justice iSini. The parties n-prc John Kainbow Stansell, of Shiiiimni, cam mission agent (appellant), and Frederick Spencer Easion, of Foxtun, Haxmiller, anil Barbara Ellen Austin, of I'oxfou, executrix of the will of the late Herbert Austin, flaxmiller (respondents). The appeal was against a decision given by Mr. Justice Cooper, who heard the original action in January, and decided in favour of Easton and Austin. Argument, which was commenced on Tuesday afternoon, was still uncompleted when the Court rose yesterday evening, Mr. Bell having addressed the' Court for the whole dav. Mr. H. D. Bell, ICC, with him Mr. A. A. S. JlenteatU, appeared for appellant, and Mr. C. H. Trea dwell for the respondents. ORDER OF HEARING. THE "WELLINGTON CASES LISTED. A further revision of fixtures was made before the Appeal Court yesterday afternoon. It was decided that the next case should lie the appeal in connection with the Horowhcnua Block, which case will come on when the case, Stansell v. Easton and Austin, has been completed. Monday next has been set aside for the case of George and Doughty and the King—an appeal concerning the assessment of Customs duties on drapers' samples. The application of the New Zealand Educational Institute for the determination of a ciuestion as to the construction of the Education Act, and its amendments, has been fixed for Tuesday.
