The Hague International Arbitration Tribunal has como to a decision with regard to Vinayak Savarkar, a young Indian student, arrested in London on charges of sedition, and extradited to India, but who on the journey out escaped from tho mail steamer at ■ Marseilles. Ho was recaptured, by ITench officials. Owing to tho fact that Savarkar had landed on French soil, the French Government complained that his re-arrest was a violation of international law, and requested a suspension of his trial. It was eventually agreed that tho question of "the legality of tho re-arrest should be submitted to arbitration, and that in the event of the prisoner's conviction the sentence should not bo carried out pending the award.
The court held that Great Britaijn was not bound to surrender Savarkar to France; : Thero was no rule in international law compelling a Power once in possession of a prisoner to surrender him owing to a foreign agent's mistake in arresting him.
