A remarkable case was heard in Berlin beforo a Court-martial of the Second Guards Division, the accused being, a young office cadet, Vicbahn by name, who whs'serving his customary period in the ranks. While he was on sentry duty on fho. artillery ehcotinn ground on the Jungfcruhoido Heath, on tho north-west of Berlin, on.thenightof August 2G. accused saw n man in a crouching position, who, he thought, was creeping up to c* tack liiml Vicbahn fired his rifle, and mortally wounded the man, who died after a couplo of hours. The heath mentioned is tho nightly haunt of suspicious characters, and this was a point in favour of occused. On the other hand, nothing was known' against tho .victim, u mechanic named Schmidtkc. Several witnesses gave evidence that the latter was sittins yuiotly on tho ground, while ono witness even declared that Schmidtko was not within .tho limits of tho -shooting ground at the time. Vicbahn was charged with causing tho death,of tho mechanic without due cause. Vicbahn, in giving evidence, stated that he, challenged tho man onco before firing:on him, and received no reply.
