MAGISTRATE'S COURT.
.(Before Mr. W. G. Riddell, S.M.) AFTER COLLECTING ACCOUNTS. FAILED TO HAND OVER MONEY. Charles Henry Fish pleaded guilty (1) that having received on iiecember lo tho sum of ill 10s. i nterms requiring him to account for. it to Sydney Gerald Cole, he failed to do so, thereby committing theft; (i) that having received'on December 24, 11)10, the sum of £1 10s., in terms requiring him to account lor it to Sydney Gerald Cole, he failed to do so; (3) that having, on January 7, 1911, received tho sum ot .£3 7s. in terms requiring him to ac- ■ count fot it to Sydney, Gerald Cole, ho failed to do so. Chief-Detective Broberg stated that Mr. Colo was tho proprietor' of a dairy business in the city. Accused had been employed by Mr. Cole to deliver milk and .butter, whilo part of his duty was to collect money from customers in payment of accounts. In several cases he had failed to pass on to his employer euch money collecl'd. Eish originally came from England, and after being out of work Eonio time was given employment by Mr. Cole Nothing was known against him in tho Dominion, but ho had a wife in the- Old Country, and when arrested in Auckland he was living with another woman. Tho sum of ■ £1 Bs. Gd. hod been found in his possession, and the Chief Detcctivo suggested that out of this iM should be handed to. Mr. Cole, and that would leave accused a few shillings when he camo out of", gaol. . . . The magistrate, after emphasising the fact that no leniency could bo shown to ; those who took advantage of the fact that they wero placed in positions of trust, imposed a sentence of one month's imprisonment on each charge, the sentences to bo concurrent. An order was mode that .£1 should bo handed to Mr. Cole out of tho money found on the accused.
PROCEEDINGS BY SUMMONS. James Hessey was charged • with wilful]}, damaging.two plate glass windows, value .£lO, tho property of Geo. Howe, The date of the alleged offence was January 2. Sub-Inspector Norwood stated that accused had been remanded from time to timo ou account of the illness of tho informant. As the latter was still.in tho hospital, it was proposed to withdraw the present informatnn and to substitute proceedings by summons. Mr. H. F. O'Lcary, who appeared for accused, had no objection to offer, and the case was accordingly adjourned until February 15 ' ALLEGED ASSAULT. George .Arthur Alilo, for whom Mr. H. P O'Lcar.Y appeared, was charged that on January 28 he did actual bodily harm to Charles Nicol. On the application of Chief-Detective Ilroberu accused was further remanded until February 8, bail being allowed ill .tSO and two euroties of «825 each*
.. OTHER CASES.--Mary Mullaii,' alias Smith, was convicted and discharged- for drunkenness, but for breach of a prohibition order issued against her she was fined 405., in default seven days' imprisonment. Ellen Elizabeth Uewit,' similarly charded, pleaded not guilty. After hearing the evidence, tho magistrate held that accused must bo convicted. A nenalty. was imposed similar to that in the caso of the previous accused. .:.:.. A prohibition order was issued against Mary Lee. ■ ~
