Mr. Payfonl, on behalf of the next-of-kin, said that the testator, Charles Phillips, who died in February, aged seventythree, had had a varied experience, having been through the Crimea and to New Zealand. Ho paid 3s. Gd. a week rent for his cubicle at Row ton House, and was thought to bo very poor. After his death a will was found in his locker. It had been tampered with by tho old man, the signature at the end of the document having been erased, together with an address and a part of tho signature of ono of the attesting witnesses. Therefore, counsel argued, the will was revoked, and the estate should go to the next-of-kin. One of tho attendants at liowton House said that Phillips rarely spent more than ■Id. a day on food, and usually ate bread and butter and drank ten. Ho occasionally was invited to share another kindly inhabitant's dinner, and then ho got \\ little meat.
Mr. Spokes, for the defendant, "Thompson and others," I lie executors of the will, contended that tho will was lint revoked.
His Lordship held that the. wilt had been revoked, and that there was an intestacy, and gave judgment accordingly.
