THE FULL PENALTY.
PREFERENCE TO UNIONIST CLAUSE,' (By Telegraph-Press Association.) ";. Auckland, December 8. Before Mr. Kettle, S.M., at the Magi* trato's Court to-day, the Auckland Certificated Engine Drivers' Union claimed, to recover from the Direct Supply' Company a penalty of ,£lO for breach of award. It was stated by Mr. Skelton for complainants that a man named -Atkinson, who was a unionist, had been missed by the defendant company and in. his stead a non-unionist was engaged. Counsel contended that the eniploviueufc of a non-unionist in place of a unionist was a deliberate breach of award. Defendants stated that- they were not aware of the clause giving preference to unionists. Atkinson was getting. up in, years, and when the staff was being reorganised he was dismissed and the other man taken on. The magistrate said in his opinion this was a case for an exemplary fine, and ho inflicted the full penalty asked for, viz., .£lO and costs £i 2s. "In a case like this," remarked Mr.' Kettle, "I think that a portion of th« fine should be given to the man affected, instead of being disposed of as at present." . .
