Roscnfeldt,.-a case that has caused a good deal of interest throughout the North -Island: The company built a creamery on : the petition of certain suppliers, jvho nndertook to continue supply* ing the creamery with, their milk or purchase the - creamery. Roseufeldt wai , not one ■of the original petitioners, but he purchased a farm belonging to one oi them, and undertook and signed for the "responsibility. The facts were admitted, but defendant's counsel ' had claimed a noii-siiit on the ground that the agreement'was not assignable, and, if assign-' able, ' was voided by reason of the r<v lease of one signatory; and also by reason of the remoteness of the purchasing' clause bringing it within the . rule against perpetuities. The Court " held that the first two grounds could not ba maintained, biit thought the third had not been sufficiently answered. Tho Court would have to non-suit plaintiffs, but did so'with great regret. It was very sorry it could not dccide on equity and good conscience, but it h-ad to decide on the law points.
