MAGISTRATE'S COURT.

SaniuelDuiming pleaded guilty to having stolen a rug valued, at 10s., the property of John Robert Holland. ,The offence occurred on Saturday last, the rug being taken from a trap in one of the city stables. Accused' was sentenced to a month's imprisonment, the rug to be returned to the.owner.
ALLEGED CONVEETING Frank Humphrey was charged with converting to his own use the sum of £2 lls. 9d., which he had received in terms requiring him to account for it to Arthur Edward Proston. Accused, who had only been a.rrested yesterday morning, applied for a remand until Friday, and this was granted. Bail was allowed. in £25, and ono surety. of £'25.
OVERLOADING A HOESE. Martin Condon, a driver in the employ of P. M'Ardle, was charged with cruelly ill-treating a horse by overloading it. Inspector Ellison prosecuted, and Mr. E. J. Fitzgibbon appeared for accused, who pleaded not guilty. Evidence for the prosecution was to the effect that on ' November 5 accused had loaded his express with thirty bags of sugar of a total weight of abont 37cwt. He had but one horse in the shafts, and alter going partly up Charlotte Street, the animal was unable to' proceed, and a , leader had to be procured.
For the defence, it was contended that the horso had not been overloaded, as it had taken two similar loads up the same street to Staples's Brewery on tho previous day. Its refusal to pull the load up on November 5 was put down to obstinacy. ' The magistrate held that accused must be convicted, and a fine of 40s. was imposed, with costs 95., and witness's expenses 65., in default seven dare' imprisonment. .
CHARGES OF VAGRANCY. Thomas Albert Lopper, charged with being a rogue and a vagabond, elected to be tried, before a jury, and was remanded until to-morrow.'
Arthur Lewis Finch, a young man, was charged with being a rogue and a vagabond in that he was found withont law-, ful excuse on an empty dwellinghouse, 120 Molcsworth • Street. He pleaded guilty. Sub-Inspector Norwood stated that from inquiries made it was ■" ascertained that accused had been looking for work and had now employment to go to. The magistrate recorded a conviction and ordered accused -to come up for sentence when called on..
INSOBRIETY.: , : \ . ■ Albert Setter, (for drunkenness,. was fined 10s. in default-48 hours' imprisonment. Edith' Horne,.. on "a- charge ■ of drunkenness, was convicted and ordered to come up for sentence-when'called on, a prohibition order, to bo. issued against her. One first-offending '.inebriate. was fined 55., with' the alternative. of 2-i hours' imprisonment,". and two other first offenders were convicted and. discharged. Ellen Elizabeth Hewat, for whom the Hon. T. W. Hislop appeared, was charged with two breaches of the terms of a pro-, hibition order. On the first charge she was fined ,405.,' with 7s. costs, in default seven days' imprisonment. On the second charge she was convicted and ordered to pay 9s. costs, in default 48 hours' imprisonment. - ..■-■'• MAINTENANCE. George Gastein, for disobedience of a maintenance order, was fined 205., in default seven days' imprisonment. Frederick Nelson William Walls consented to an order, to pay 10s. a week towards the maintenance of one of his children; also to : pay 'costs .£2 2s. Mr. A. Dunn was for complainant and Hr. K. Kirkcaldie for defendant. The charge against William Slattery for alleged failure to maintain an illegitimate child was dismissed. without prejudice, no costs being- awarded. Mr. M'Nab was for defendant and Mr. A.. Dunn for complainant. '- An application by Arnold Arthur Emery to have an order varied and arrears remitted was granted. The arrears were remitted and- the order cancelled-. ' An adjournment till December 12 was eranted in the case in which Maggie Josephine O'Flaherty applied to have a maintenance-order, varied. ■Bearing of the-charge against -Ada. Curry (Mr. C. R. Dix), of failing to maintain her children in an industrial school, was adjourned till November. 18. An adjournment till November 21 was wanted in the case against Martin Pollock for alleged disobedience of an order. An adjournment till November 21 was also granted in the case of Furby v.. Furbv, application for maintenance. Mr. K - Kirkcaldie appeared for complainant, and Mr. P. Jackson for defendant. .
OTHER. CASES. ■Norman Ml«an. pleaded guilty _to a charge of deserting from tho steamer Moravshiro on November 1. He was fined 105.,-with costs 7s. in default 48 hours imprisonment. ■ Daniel Buchanan, for whom Mr. J, ; J. M'Grath appeared, was charged with drunkenness and with assaulting Charles Patchett. On the application of counsel, accused was remanded until to-morrow, bail'being allowed in tho suni of £&. ■ William Grant ' Spiers,. charged with leaving Dunedjn without making .provision -for an unborn illegitimate child;, was remanded to appear at the Magistrate s Court, Dunedin, on November 17. An assault charge, Frederick Wales v. David Round, and a cross action Round v Wales were withdrawn by leave of. the Court. Mr. J. J. M'Grath appeared for Wales. - ! , . v . For not having' lights on vehicles at night, John Millante and William M'Lean were each fined 10s., with costs 75., in default 48 hours' imprisonment. A prohibition order was issued against Mary Donaldson, to take effect, for - ouo year.
