MAGISTRATE'S COURT.

(Before Mr. W. G. Riddell, S.M.) ALLEGED HOUSEBREAKING. Frederick Blacklidge, when charged with theft of a bicycle, value £5, the proprty of Ernest Rough, elected to be tried by a jury. The same accused . was charged with breaking and entering the dwelling of Thomas Wm.. Hislop on or about October 29, and stealing sundry articles valued at ,£ls. On the application of Chief-Detective Broberg, accused was remanded until Thursday nest. REPAIES TO DIVIDING FENCE. Alfred Andrew Mitchell was oharged on the information of James W. Mexted with failing to repair a dividing fence. Mr. J. J. M'Grath appeared for the informant, and Mr. ■D. Jackson , for defendant. Tho parties to the action are both farmers on adjoining properties, in the Porirua district, and have had a dispute over a' boundary fence, which is in need of repair.' The informant contends that certain repairs will make the fence stock pi-oof, but the defendant claims that nothing but a new fence will meet requirements, and so the dispute was brought to Court for the Magistrate to decide. After hearing lengthy evidence, his Worship intimated that he would give his decision on Wednesday. OTHER CASES. Frederick -Sherlock Jones, 22 years of age, was brought forward for on a charge of indecency in the Botanical Gardens. He had pleaded guilty to the offence at a former sitting of the Court.Mr. R. H. Webb appeared for the accused, and asked for leniency. The Magistrate imposed a sentence of one year's imprisonment. Harry Hooper, for whom Mr. V. B. Meredith appeared, pleaded guilty to' a charge of using improper language within the hearing of persons in Upland Road. A fine of .£5 was imposed, with costs 11s., in default twenty-one days' imprisonment. .

Martin Sarauelson pleaded guilty to' a charge of drunkenness, and to a further charge of procuring liquor during the currency of a prohibition order. For the latter offence he was fined 405., with the alternative of seven days' imprisonment, and on the charge of drunkenness he was convicted and discharged. John .Crory, for drunkenness, was fined 205., in default seven days' imprisonment. William Newcombe; alias O'Kourke, alias Jeffs, alias Eoxburghy, and Martin Ford, similarly charged, were each fined 10s., in default forty-eight hours' imprisonment. Three first-offending inebriates who failed to appear, ■ were ordered to forfeit their bail of 10s. each, in default to serve twenty-four hours in gaol.. A prohibition order was issued against Win. Steven for one year. Mr. Neilson appeared for: the applicant. ■ For disobedience of a' maintenance order, Willie Bertram Jackson was sentenced to two months' imprisonment in the Auckland prison. Mr. P. Jackson appeared for the complainant. A case against Minnie MTDonald, for failing to maintain a child in an industrial school, was withdrawn by leave* of the' Court.

In the following cases there was no appearance of either party, and the informations were dismissed:—Bevan v. Bevan, application to increase a maintenance order; M Nab v. M'Nab; Dickson v. Carswell; and Robertson-v. Eobertson, alleged disobedience of orders. > • ',
