IBy Telegraph.—Press * Association;) H> BILLIARD SALOON MEN'S APPEAL. Auckland, November 4. A meeting of billiard saloon keeper? has decided to., raise-funds'for an appeal against a recent decision of Mr. Cutten, S.M., to the effect that saloons where pool is played for small stakes are common gaming houses. Mr. Kent, • solicitor on their behalf, has telegraphed to Dr. Findlay suggesting that instructions be given to the police to permit matters to go on as before, pending the decision on appeal. Dr. Findlay replied that he did not care to interfere with. police proceedings, but had communicated with the Commissioner of Police to the effect that the suggestion seems reasonable if the . appeal is prosecuted with due diligence. ~ ARBITRATORS' FEES. ■ Nelson, November 4. In the Magistrate's Court to-day Mr. Evans, S.M., held that the Magistrate's Court has no jurisdiction to heal a claim for arbitrators' fees in the absence of an express agreement between the parties for submission to the arbitrators, in which agreement the fee is fixed. Also that the inclusion of the fee in the awaTd does not form part of such an agreement, the remedy on an implied agreement being in the Supreme' Court, under Section 22, Arbitration Act, 1908. Walmate, November S. A successful agricultural show was held here to-day in fine weather. There was a record attendance and .the chief prized takers were local exhibitors. Rain is much wanted here. The crops' are beginning to show the effect ,of the' drought.
