TRESPASS OR RIGHT-OF-WAY? FARMERS AT VARIANCE. " '' A dispute between two farmers of Oroua Bridge about an alleged rigkt-of-. way engaged the attention of Mr.JJuts t tice Cooper at a sitting of the Supreme Court in Banco yesterday. The plaintiff, Bernard Fletcher Grace, claimed- £50' damages for trespass by the defendant, William Bryant Vater Pearce, with horses and drays on land leased by the plaintiff at Oroua Bridge, and asked also for an injunction restricting the defendant from further trespass on the land. The main defence was that the de-. fendant had merely used a right-of-way which had existed for many years across the land (Lot 1, Lower Aorangi, 3G, 2B) and which gave access from the Foxton Road.to land leased by defendant. The case had already been partly heard at Palmerston North. • ■ Mr. G. Moore appeared for the plain-' tiff, and Mr. H. R. Cooper and Mr. Bagnall for the defendant. After hearing argument, Ibis Honour reserved his decision. PRISONERS FOR SENTENCE. TO COME UP TO-DAY. GoWstone,' at" Eltham and stealing' £14 cash and goods" to the value of £17 9s. 4idi, (3) breaking and entering the shed of Leonard Greswell, of Eltham, grocer, and stealing goods to' the value' of: £1, lis.'- 6d.
