HOW THE STATE SETTLED A' • CLAIM. ■ .. . Unusual circumstances in connection with the settlement of a claim by Mra. Douglas, of Kawhia, against the Government were the subject of a brief but interesting'discussion in tho House of Representatives yesterday. • Mr. Herfies, M.V. for Tauranga, stated that a Royal Commission 'which had inquired into' the claim recommended that .CI4IH, should be paid to the claimant At _ tho instance of the Government,' claimant, who was - unaware of tho amount of the award,. accepted in' full satisfaction of heivclaim. Seeing that she had .given a receipt for, the amount, she hud no legal claim against the' Crown, but equitably, it was a very, sorry thing for the Government to sheitei itself under a receipt given in those circumstances. Ho was glad to see that a committee of the House had recommended her further claim for favourable consideration.
Mr. Maseey, declared that the worst feature of Hie whole affair was the concealment. that had'taken place ori the part of the Government. The report of the Royal Coinmisi-ioii should have been submitted lo l'iiilianiei.t "during the next succeeding .session," and such steps should have been taken "as Parliament directs." But the Government had not complied with those directions. Was it lair? He did not think that it could lie called straightforward.
The.Hon. .T. Carroll (who was filling the position of Acting-Premier) said that the amount recommended to be paid-was about i'SOO net. The Government (ho continued) -had discretionary power in the mutter as to whether an;award was excessive or not. It;, was felt'that the amount awarded was excessive, so the Government had only naid what it considered was a- reasonable amount. As the matter Was' to be further considered, ho had no objection to steps being taken by the l.Rnds Department, with a view of seeing whether further light could be thrown on the subject, and to see if claimant shonld ■be awarded an extra sum by way of additional compensation. It was then agreed that the report of the cimmutcc shofXd ! be, laid on the table. ■'
