WHY MR. MACK AY IS ACTING.

(By Telegraph—Special Correspondent.) Wanganui, July 11. At 'a meeting cf ' defendants in tte racecourse trespass case, held on Saturday night, it was unanimously decided to write a letter of thanks to the JockeyClub for its leniency in foregoing its claim for costs against defendants, and stating that neither tho latter nor their committee were connected with any limitation now pending. It was also decided to send a letter of- thank's" to •Messrs. Hatrick and Bignell for the interest which they had shown in defendants' cases. In regard to the summons issued bj ilr. C. K. Mackay against the racecourse, trustees, Mr. Mackay states that his reason for issuing it is that, when in Wellington recently, ho visited the Department of internal Affairs on some borough business, and was informed that it was proposed by the Government to appoint noTf trustees, of whom he was one. As he believed that the trustees should be elected, as provided by the Act, he thought it best to have the question settled at once, especially as the election, if any, should be held next month, and the present leaso to the Jockey Club expires in September. He. therefore, at once issued a summons. The case will probably be heard on Wednesday.
