Before Mr. A. D. Thomson, S.JI., at the Cpnrt yesterday morning, David Herlihy proceeded against Andrew Robinson to have tho latter, bound over to keep tho peace, as complainant feared thai hi. would receive bodily harm from ltobinson. Complainant gave evidence to the effect that on June 17 Robinson met him on the Aorangi Road and said: "Now I have you, I intend to settle accounts with you." Robinson, who was 011 horseback, then chased him about a mile. Horlihy produced a diary in which he had made entries of several occurrences in which he had been assaulted and ' molested by Robinson. Crossexamined, Herlihy stated that ho hail had disagreements with several of his neighbours. There was some quarrel with Robinson about tho latter's horses having been impounded iu Octolwr last. On the day of the. chase on the Aorangi Road both were oil horseback, and when complainant saw what Robinson's intentions were ho put his horse to the gallop. He (Herlihy) was mounted ou a good hack, and to that lie owed tho fact that he escaped. After hearing botli sides, tho magistrate stated that ho was satisfied that there was no real danger to Herlihy when Robinson met him on tho occasion referred to, though no. doubt Robinson had pursued him meaning to give him. a fright.
