<h TARARUA VINEYARDS CASE. REHEARING SOUGHT. Reference was mado in Chambers yesterday before his Honour the Chc'ef Justice to the case of Nathaniel Miller, police sergeant, Maisferton, v. Geo.rge Lamb, vintner, Masterton. The bitter had, at liis own request, been, made respondent in an action to test whether or not selling New Zealand wine in a No-License district constituted a breach of the law. At tho first hearing, in the. Magistrate's Court ; Mr. Graiham, S.M., dismissed the information. The Crown. appeaJed, and his Honour : the Chief Justice reversed the decision of the S.M., and held that the railing of Now Zealand wine was illegal in a No-Licenee district. When the decision of the .Court was given, on Tuesday an application by respondent'n counsel for leave to appeal was held over. The matter cam* up again yesterday morni'Tiia;, when Mr. C. P. Skerrott, K.C. (for respondent), together with Mr. F. P. Kefily, ih.t.imated that ho intended to abandon the appeal. He desired, however, to apply for a reheaaing before the Full Court. His Honour reserved his decision on this application. Mr. J. W. Salmond, SoliriitOT-Gen-<ral, with whom Mr. H. H. Ostfcr appeared, represented the Crown.
