CLAIM FOR DAMAGES.
.£SOOO AWARDED. By Te!eeraph-Prcs3 Aasociation-CopyrtehO (Eec. June 1, 1.5 a.m.) Melbourne, May 31. Varaiva has been awarded .£SOOO damages and costs against the Howard Smith Company. The judge held that defend; ants' action against plaintiff was not justified. The above case, in which Peter Fedo-,' rovitch' Varawa, a Russian subject,' claimed .£20,000 damages for false imprisonment at Sydney in January, 1305, from the Howard Smith Company, was heard before Mr. Justice A'Beckett and a jury of twelve, in the First Civil Court. On January 21; 1905, following negotiations for the sale of the steamer Peregrine, the defendant company instituted proceedings . against Varawa for breach of agreement, and he was arrested when leaving New, South Wales, and held in Darlinghurst Gaol on a writ Cf capias for 11 days till security far ,£IOOO was forthcoming. On this "arrest the present action was brought. The defendants denied liability, or that Varawa had' any cause of action.
