9 — CLAIM FOR ,£6OO DAMAGES. (Ey TeleeraDh—Press Association.) Dunedin, May 17. Mr. Justice Williams and a jury of twelve were engaged in the Supremo Court today in hearing an action brought by Joseph Albert Wadded, schoolmaster, of Moonlight, against Andrew Uarvie, sheep-farmer, Nentborn, the- plaintiff, claiming JiGOO damages for alleged slander. _ PlaintilF claimed that on or about November 14, defendant falsely and maliciously wrote and published a letter addressed and sent by him to the secretary of tho Otago Education Board, this letter containing words alleging that plaintiff had, on occasions, neglected to attend school; that lio had made false entries in the school register; that ho was incompetent and negligent; that he was addicted to drink. Defendant said that the words in tho letter were not written or published with (nor do they "boar) the meanings alleged by plaintiff,' or any defamatory 'meaning; that tho words were written and published by defendant (if at all) without malice, and in the belief that they were true and privileged; that the letter was written (if at all) by defendant to the board in lona fide exorcise of his right and duty, and was sont in response to a coinmnnication from tho board on t.lio subject. Tho case was not finished when the . Court rose.
