MAGISTRATE'S COURT.
BROTHER AGAINST BROTHER. (Before Mr. W. G. Eiddoll, SM.) At tho Magistrate's Court on Saturday Edward Bibby was charged with having on February 28 assaulted, his brother, John Charles Bibby, so as to cause him actual bodily ■harm. Mr." P< W. Jackson' appeared, for accused. ,Tho charge was amended to one of common assault, and ' accused pleaded, not guilty.,John Uhas. Bibby, who-appeared with his eyo bandaged, gave his occupation as a wool-classer, but;-now a : showman.;. He had a difference with his brother near Dykes's stables'.on. the evening, of February., 28. 'He had gone; to the yard to.get tho horses for show purposes, and was endeavouring to catch them, when two or thre'o men whom ho did not know—it was dark at the time—set up ari argument about aiding them: Accused appeared on tho scene while he (witness) was endeavouring to catch a rather vicious mare. An altercation ensued, and the maro reeled up, tho coronet of her hoof camo over him, and ho did not know whether his brother struck him or not. Horaco Eupert Maybcrry gave evidence as to the altercation, and similar evidence was given by -other witnesses. Edward Bibby, horse • trainer, stated that ho was proprietor of Bibby's Buckjumpers, and tho, .complainant also had an interest in the' show. ' On. the evening in question complainant was endeavouring to catch a horsoin tho yard, and he (witness) asked him what he was going to do with it. The reply given was: "Mind your own business." Complainant was slightly under the influence of drink, and as there wero several others present, and witness thought that they waited ,to havo.somo fun, lie put■ m>. the rafts to prevent tho horso being taken out. Complainant then took hold of him, bnt witness pushed him away, and he (complainant) fell to the ground. On rising again complainant wanted to fight, but witness merely > remarked that it was foolish to carry on liko that. Complainant then rushed at him, and he (witness) struck him unintentionally. Complainant then became excited and they both closed. His Worship fined accused £5, with £1 is. costs, in default fourteen days' imprisonment. , ■ ■ '■
OTHEE iCASES. ,Gcorgo Stant and Kato Morgan, alias Dochcrty, wero charged with committing a grossly. indecent act. Both were remanded to appear on March 9. Nicholas Crawford, charged with committing an indecent act, was sentenced to 14 days' imprisonment. Accused had previous convictions against Mm of a similar nature. John Kilmartin, against whom a similar charge was laid, was fined jC3, tho alternative being 21 days' imprisonment. Arthur Fairless, deemed to be a rogue and vagabond, pleady guilt)-, aod was ordered 'to come up for sentence when called upon. : James O'Grady, charged with continued drunkenness, was sentenced to one month's imprisonment. ■ Hugh Adams, alias MTJougall, for a similar offenco was fined 205., or seven days' imprisonment. Clara Brnnnigan and Frank Eoberts, charged with insobrioty, wero each J»e<l 10s., with tho option of 43 hours' imprisonment. : ; Two first offending inebriates were dealt with, and one who did not appear forfeited his bail, 10s. Violet Campbell, on a charge of drunkenness, was fined 55., in default 24 hours' imprisonment, and on a further charge of procuring liquor from some person unknown during the currency of o. prohibition order was fined 405., in default seven , days' imprisonment.
