Docksey. •''\Evidenco showed that both plaintiff and defendant were passengers by the Arawa from Lon- , don, and it appeared that certain financial complications arose out of card-play-ing on the trip. Defendant alleged that on arrival. Docksey., owed him 10s., and. ho took his own means of recovering the money. Docksey said he paid- tho money back on the day of arrival in Wellington. : His Worship said Docksey: may have owed accused 10s., but accused had still committed theft of the glads'tone bagV The proper way to recover the moaey, if it was owing, was to sue. for it civilly.
