Defendant was charged with that, during tho month of January, Vat Wellington, lus .was tho occupier. of premises known.as 63 Haining Street, and did'use the same as a common gaming-house., It had been proved (said his Worship) that defendant was found on ;,thb promises mentioned in the' 'information on various dates' in tho month of January, and that ho had sold' pakapoo tickets'to two probationers on different dates.;' Defendant called no evidence, and his counsel had submitted: that the information should be..dismissed on tho following grounds:— (1) /fhat. there was no proof'., that tho house., in' which defendant: was 1 found' was a. common gaming-house ..within trio meaning of the Gaming Act, .1908; ;(2) that thprd was" no proof "that' the.house was..k"ent or used for playing an unlawful gamo';. (3). that..there was no'.proof that any. unlawful. name, was: being "played within: the meaning of tho! Gaming Act 1008;" (i) that .there was',no. proof .that tusj premises were owned or occupied by defendant within 'tho meaning of the Gaming Act, 1908; (5). that- the evidcric'o adduced by,tho prosecution/was tho-evi-dence of • n6c-)mplijcs, and,•'.without, .corroboration, was. not sufficient, to' put defendant upon his defence.' .The Evidence (continued; his Worship), showed that-de-fendant was, acting on .the, dates referred u.
