1 AN IMPORTANT POINT. , 'By Telegraph.- I'rcii: Association i Chnstchurch, November 25. At the Supreme Court, before Mr. Justice Denniston, application was made for the construction of the cliuises in the Dentists Act in regard to the admission of Frank~C Fryer. Mi. H n. Loughnan appeared on behalf of applicant, and Air. G. Harper, by arrangement, for the Crown. Mr. Loughnan mentioned that the matter Has one of bome urgency, as an amendment of the Act might be required to meot this and other similar cases if the Conrt found that _ applicant could not bo admitted as a dentist under tho present law. Tho case was an appeal against the refusal of the RegistrarGeneral , of Births, Deaths, and Marriages to register applicant as a dentist. Applicant served his apprenticeship for throe years, and passed hie examinations as required by thv original Dentists Act His apprenticeship commenced on 'January 7, 1005, and concluded on tho same date in 1908. The Dentists Act of 1904 was dated November 8, 1901, and came into operation on January 10, 1905, Application for registration Vita made on June 28, 1909, and was refused on. the gjound appal entlj that applicant was 1 entitled to be ad lnitted under Section 11 of the Dentists Act oj 1904. Applicant was examined-under the Act of 1880, under which examiners were appointed b,r the Senate of the University The Aet of 1904 required part of the university course and terms to be kept When the latter Act wae passed it was anticipated that it would be a dead letter, owing to an extraordinary clause at the conclusion. Counsel contended that tho Act of 190 i did not operate in any way until Jannary 10, 1905, and that applicant came .within the exemptions mentioned in the Act. Mr. Harper said that the contention of the Registrar-General was that the object of Section 11 was to save all apprentices and persons, who, at the time of the passing of the Act, had complied with the Act of 1880 Anyone who became an apprentice aftor tho passing/of the Act was awaro that if the Act camp into operation on January 10, 1001. ho would havo to qualify as the holder of a degree m dental surgery in tho University of Now Zealand His Honour reserved his decision. *
