• (From. Our SBtcial Eerortef .1 . - _—_ * :—_ PETONE POLICE COURT. /■ A-sitting of the Petone Police Court was held yesterday morning beforo Messrs, G. ,T. London, S. E. Johnson, and T. W. Caverhill, J.P.'s.. George Eraser, was charged with sounding . a', false fire-alarm; , Mr. P. W. • Jackson, who appeared for the defence, claimed a nonsuit, on the ground that though tho offence alleged was one against the by-laws,, a copy of the by-law had not been put in as evidence. The Bench,- however, over-ruled this objection, Mr. London' siddingthat where thero was an offence against a statute, the statute was not put in. .Why, therefore, should they have to put. in the by-law? Mr. Jackson bowed to tho decision of the Bench,. though remarking that he could not endorse, the wisdom of it. He asked for an adjournment to October It, in order that he might call further evidence. This was granted. ■ ■ '■ ' Ellen Ryan was prosecuted by Jane Bates (Mr. Jackson), .on a charge of assault, and fined 55., and costs ,£2 40s. 2d., in default seven Jays' imprisonment. ' For allowing stock to wander, • Joseph D. Postine, Halstead Harley, and Edward Steer were fined 10s., and costs 20s. each. A conviction without costs was entered against Sydney Clark charged with having an unregistered dog. in'his possession. . . , : ,'. '. ~ . ! • HTJTT EIVEE BOAEO • The monthly. meeting of. the. Hutt Eiver Board was.held last evening, when there were present: Messrs. E. Stevens,(in 'the chair), 0. Stevens,'H.Sladden, tho engineer; (Mr.-Laing-Meason), and the solicitor to the board (Mr. £ P. Bunny). .. A letter was received from the .Petone Borough Council asking the board to-dedicate,a piece of land for bridge approaches, to Gear Island. ■ Later, in the evening Mr. J. W. MTSwan (Mayor of Petone),and Mr. W.H.Cook (engineer to the Petone Borough) waited on the board to further the application. In ,answ.er to. Mr. M'Ewan, the chairman .said that somo two years ■ ago•the board sent a letter to the Petone Council making an offer'of. the land for .the'sum'of .£750. -They had not yet >received a, reply to that letter. He himselfdid not wish the work to be hung up, and suggested, that if the -council, were not pre- i pared to give .£750,. they should name some sum which they.wbnld.be willing to-give. The board was not prepared to make a free gift of the .land. After the deputation had withdrawn, it,; was resolved . that .• the matter be left in the solicitor's hands. ..' ' " The overseer reported inter alia that from September 18 to 22 .the river was flooded, the rise ranging from 3ft. to sft. above summer level. Generally no damage 'Was sustained by the protection works, save at' Chapman's Bend in-a section of the wb'rkVwhich was not supported by piles.' The damage done necessitated the building of two chains of' new. work, consisting of iron piles and willow fence'backed with scrub. ,The report, was adopted. A: HUTT CASE-EESERVED DECISION.,' His Worship Dr. M'Arthur delivered his reserved judgment at Wellington yesterday in the. case (heard at Lower Hutt) of Elouise Emma Adams (Mr. P. W. Jackson) v. Skitrip andOusey (Mr. J. J. M'Grath). The plaintiff' claimed from the defendants possession of one cream cow, the property of the plaintiff "■ wrongfully detained'by the'defendants, or its value (£&). The,agister, said his Worship, has no; lien, in the, absence of .special arrangement,, upon the beasts he agists, for he expends no skill upon them. He merely takes-care.of them, and supplies them with food, and his remedy is to bring an action for the price of the grazing. Judgment would: be for the plaintiff for' the possession of: the.cow on or before October 9, or for the sup,of .£B. !.■■'.
